Terms and Conditions – Market Test

1. Introduction and Acceptance of Terms
 

These Terms and Conditions govern your participation in the Market Test conducted by kommit ("the Company").


By scheduling an interview through the provided link, you confirm that you have read, understood, and agree to be bound by these Terms.
 

2. Purpose of the Market Test

 

The purpose of this Market Test is to gather qualitative feedback on potential B2B services. Your participation and insights will be used exclusively for internal research and development to help the Company design solutions that solve real market problems. This is not a commercial activity, and you are under no obligation to purchase any product or service.
 

3. Eligibility and Participation

Participation is by invitation only. To be eligible for compensation, the Participant must:
Provide accurate and truthful information in the pre-interview survey.

  • Attend the scheduled 30-minute interview.

  • Participate in good faith by answering the interview questions to the best of their ability.

  • Failure to genuinely participate in the interview may result in the forfeiture of any compensation.

4. Compensation

 

As a thank you for your time and valuable feedback, Participants are entitled to choose one of the following compensation options:

  • Option A: A $100 USD Amazon Gift Card.

  • Option B: The implementation of one (1) localized automation, corresponding to a maximum of twenty (20) engineering hours.

4.1. Change of Compensation Choice
A Participant may change their selected compensation option by providing written notice to bizdev@kommit.co no later than two (2) business days after submitting the pre-interview survey. After this period, the chosen compensation is final.
 

4.2. Terms for Amazon Gift Card

If Option A is selected, the gift card will be delivered electronically to the email address provided by the Participant in the survey. The delivery will be made within five (5) business days following the successful completion of the interview.
 

4.3. Terms for Automation Service
If Option B is selected, the following conditions apply:

  • a. Non-Disclosure Agreement (NDA): The Participant must sign a mutual Non-Disclosure Agreement (NDA) provided by the Company before any technical work or information exchange can commence.

  • b. Scoping and Initiation: The scope of the automation will be mutually defined after the interview. The service is strictly limited to a maximum of twenty (20) engineering hours. The Company will begin the implementation of the service within thirty (30) calendar days after the interview is completed.

  • c. Post-Implementation Responsibility: Upon completion and delivery of the automation, the Participant is solely responsible for its ongoing use, maintenance, and support. The Company has no obligation to provide updates, fix issues, or make improvements beyond the initial 20-hour scope.

  • d. Additional Services: Should the Participant require maintenance or enhancements beyond the initial 20 hours, they may engage the Company for additional services under a separate commercial agreement.

5. Confidentiality and Data Privacy

 

The Company is committed to protecting your privacy.

  • The identity of the Participant and their company, along with all responses provided during the interview, will be treated as strictly confidential.

  • The collected data will be used solely for the Company's internal product and service development purposes.

  • Your name, company, or any identifying information will never be publicly disclosed or used in external marketing materials without your explicit prior written consent.

6. Intellectual Property

 

For Participants who select the automation service (Option B):

  • The Company shall retain all intellectual property rights to its pre-existing tools, source code, methodologies, and know-how used to create the automation.

  • The Participant is granted a non-exclusive, perpetual, royalty-free license to use the specific automation delivered to them for their internal business operations.

7. Disclaimer

 

The automation service provided as compensation is delivered on an "as-is" basis. The Company makes no warranties, express or implied, regarding its performance, reliability, or suitability for any particular purpose. The Company shall not be liable for any direct or indirect damages arising from the use or inability to use the automation.
